By accessing our website, booking our services, or participating in our mountain river adventures, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

3. Service Description

fourlezbqd provides mountain river adventure services including:

  • Guided river tours on mountain rivers
  • Multi-day river expeditions and camping experiences
  • Custom adventure planning and execution
  • Safety equipment and professional guidance
  • Educational experiences about mountain river environments

4. Booking and Reservations

4.1 Booking Process

  • All bookings must be made through our official channels
  • Bookings are confirmed upon receipt of payment and our written confirmation
  • We reserve the right to refuse service to anyone
  • Availability is subject to weather conditions and safety considerations

4.2 Age and Health Requirements

  • Participants must be physically capable of participating in outdoor adventures
  • Minors must be accompanied by a responsible adult
  • Participants must disclose relevant health conditions
  • We may require medical clearance for certain activities

4.3 Group Size and Modifications

  • Group sizes are limited for safety and quality reasons
  • We reserve the right to modify itineraries for safety or operational reasons
  • Alternative activities may be provided if conditions require changes

5. Payment Terms

5.1 Pricing and Currency

  • All prices are quoted in Euros (EUR) and include applicable VAT
  • Prices are subject to change without notice until booking is confirmed
  • Additional costs (transport, accommodation) may apply as specified

5.2 Payment Schedule

  • Full payment is required for day trips at time of booking
  • Multi-day expeditions require 50% deposit, balance due 14 days before departure
  • Late payment may result in cancellation of booking
  • We accept major credit cards and bank transfers

6. Cancellation and Refund Policy

6.1 Customer Cancellations

  • 48+ hours before: Full refund minus 5% processing fee
  • 24-48 hours before: 50% refund
  • Less than 24 hours: No refund unless exceptional circumstances
  • Multi-day expeditions: Different terms apply, specified at booking

6.2 fourlezbqd Cancellations

  • We may cancel for safety, weather, or operational reasons
  • Full refund or rescheduling offered for our cancellations
  • We are not liable for consequential costs (travel, accommodation)
  • Minimum group sizes may be required for some activities

7. Safety and Risk Acknowledgment

7.1 Inherent Risks

Mountain river activities involve inherent risks including but not limited to:

  • Drowning, hypothermia, and water-related injuries
  • Slips, falls, and impact injuries
  • Weather-related hazards and exposure
  • Wildlife encounters and environmental hazards
  • Equipment failure or malfunction
  • Remote location and delayed emergency response

7.2 Participant Responsibilities

  • Follow all safety instructions and guidance from our staff
  • Disclose relevant health conditions and fitness levels
  • Wear provided safety equipment at all times
  • Inform guides of any concerns or difficulties immediately
  • Abstain from alcohol and drugs during activities

7.3 Safety Measures

  • All guides are trained in swift water rescue and first aid
  • Professional-grade safety equipment is provided
  • Activities are planned according to current conditions
  • Emergency communication and evacuation procedures are in place

8. Limitation of Liability

8.1 Liability Cap

fourlezbqd's total liability for any claim arising from our services is limited to the amount paid for the specific service, except where prohibited by law. This limitation applies to all types of damages including direct, indirect, incidental, and consequential damages.

8.2 Exclusions

We are not liable for:

  • Injuries resulting from participant's failure to follow instructions
  • Losses due to weather or natural conditions
  • Personal property damage or loss
  • Travel delays or cancellations by third parties
  • Consequences of pre-existing medical conditions

8.3 Insurance Recommendation

We strongly recommend that all participants obtain comprehensive travel and activity insurance covering adventure sports, medical expenses, and trip cancellation.

9. Participant Conduct

Participants must:

  • Treat fellow participants, guides, and staff with respect
  • Follow environmental protection guidelines
  • Comply with local laws and regulations
  • Not engage in behavior that endangers others
  • Respect private property and natural environments

We reserve the right to remove participants who violate conduct standards, with no refund provided.

10. Intellectual Property

All content on our website and materials, including but not limited to:

  • Text, images, logos, and design elements
  • Route information and itineraries
  • Training materials and safety protocols
  • Photography and video content

This content is owned by fourlezbqd or used with permission and is protected by copyright and other intellectual property laws. Unauthorized use is prohibited.

11. Photography and Media

By participating in our services, you consent to fourlezbqd photographing and recording your participation for marketing and promotional purposes. If you prefer not to be photographed, please inform your guide at the beginning of the activity.

12. Privacy and Data Protection

Your personal information is handled according to our Privacy Policy, which forms part of these terms. We comply with applicable data protection laws including GDPR.

13. Force Majeure

fourlezbqd is not liable for inability to perform services due to circumstances beyond our reasonable control, including natural disasters, extreme weather, government actions, labor disputes, or other force majeure events. In such cases, we will work with you to reschedule or provide appropriate alternatives.

14. Governing Law and Jurisdiction

These Terms of Service are governed by Dutch law. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands. The parties agree to attempt resolution through mediation before pursuing litigation.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

16. Modifications to Terms

fourlezbqd reserves the right to modify these Terms of Service at any time. Changes will be posted on our website and take effect immediately. Continued use of our services after changes constitutes acceptance of the modified terms. For significant changes, we will provide advance notice to existing customers.
